From 30 December 2025, the Home Office can cancel pre-settled or settled status if they believe it is more likely than not that someone helped another person make a fraudulent immigration application after 31 December 2020.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier this year in the October 2025 Statement of Changes, the&nbsp;government updated the rules around Grounds for Refusal, including visa curtailment. They did this to make the rules more universal and simpler to understand. Now, the EUSS rules have been updated to bring them into alignment with those related to visa curtailment.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Essentially, anyone&nbsp;with pre-settled status who has&nbsp;assisted&nbsp;someone with fraudulently entering the UK, will now have their visa curtailed. There will be an appeal process for people who think they have grounds to appeal.&nbsp;However, this is not about small mistakes or misunderstandings;&nbsp;it is about deliberately helping with false or dishonest applications. A criminal conviction is not&nbsp;required&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Statement of Changes is\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/statement-of-changes-to-the-immigration-rules-hc-1491-9-december-2025\/statement-of-changes-to-the-immigration-rules-hc-1491-9-december-2025-accessible\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">here<\/a>.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Understanding destitution and homelessness in the asylum and immigration system\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Findings from<a href=\"https:\/\/naccom.org.uk\/annual-survey-data-briefing-2025\/\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">\u202fNACCOM\u2019s Annual Survey 2025<\/a>\u202fhighlight a worsening national crisis of destitution and homelessness in the UK\u2019s asylum and immigration system, driven by government policy.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"900\" height=\"500\" src=\"https:\/\/housing-rights.info\/news\/wp-content\/uploads\/Housing-Rights-Winter-2026-Naccom.png\" alt=\"Housing Rights Winter 2026 Naccom\" class=\"wp-image-409\" srcset=\"https:\/\/housing-rights.info\/news\/wp-content\/uploads\/Housing-Rights-Winter-2026-Naccom.png 900w, https:\/\/housing-rights.info\/news\/wp-content\/uploads\/Housing-Rights-Winter-2026-Naccom-300x167.png 300w, https:\/\/housing-rights.info\/news\/wp-content\/uploads\/Housing-Rights-Winter-2026-Naccom-768x427.png 768w\" sizes=\"auto, (max-width: 900px) 100vw, 900px\" \/><figcaption class=\"wp-element-caption\">Map from\u00a0the\u00a0NACCOM report, showing countries of origin of people accommodated in 2025\u00a0<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Key findings include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An entrenched migrant homelessness crisis\u00a0<\/li>\n\n\n\n<li>The network accommodated 4,434 people\u202f\u2014\u00a0the highest number on record\u00a0<\/li>\n\n\n\n<li>829 people\u202fwere rough sleeping at the point they accessed services, more than double pre-2023 levels.<\/li>\n\n\n\n<li>Refugees are being failed by statutory services and a shortened move-on period\u00a0<\/li>\n\n\n\n<li>2,008 refugees\u202fwere accommodated by NACCOM members \u2014 a three per cent increase on 2023\/24 and a 106 per cent increase on 2022\/23\u00a0<\/li>\n\n\n\n<li>71 per cent\u202fof organisations said the temporary extension of the move-on period to 56 days reduced homelessness risk\u00a0\u2014\u00a0a change that has since been reversed.\u00a0<\/li>\n\n\n\n<li>NRPF conditions are forcing people into destitution\u00a0<\/li>\n\n\n\n<li>1,509 people\u202fwith restricted eligibility or NRPF\u202f\u2014\u00a0barred from accessing most mainstream housing and homelessness\u00a0support were\u00a0accommodated by\u00a0NACCOM\u00a0members.\u00a0<\/li>\n\n\n\n<li>Legal advice shortages place growing pressures on grassroots services\u00a0<\/li>\n\n\n\n<li>The legal aid crisis is placing growing pressures on frontline services\u00a0\u2014 65\u00a0per\u00a0cent of\u00a0respondents reported\u00a0an increased demand for their advice services, with\u00a0nearly two-thirds\u202funable to meet the rise in demand.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Home Office must consider whether to exercise discretion in Windrush cases\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The requirements for\u00a0remaining\u00a0in the UK under the Windrush scheme are outlined in the Home Office\u2019s\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/windrush-scheme-casework-guidance\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">casework guidance<\/a>. For the child of a Commonwealth citizen who was settled in the UK before 1 January 1971,\u00a0the guidance requires that the applicant has been continuously\u00a0a\u00a0resident in the UK since their birth or arrival.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appellant in\u00a0<em>Hippolyte v Secretary of State for the Home Department<\/em>\u00a0<a href=\"https:\/\/www.bailii.org\/ew\/cases\/EWCA\/Civ\/2025\/1493.html\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">[2025] EWCA Civ 1493<\/a>\u00a0could not meet this requirement,\u00a0<a href=\"https:\/\/freemovement.org.uk\/home-office-must-consider-whether-to-exercise-discretion-in-windrush-cases\/\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">reports<\/a>\u00a0<em>Free Movement<\/em>. It was argued that it ought to be open to her to\u00a0seek\u00a0to persuade the Home Office to nonetheless grant her indefinite leave to remain due to her strong and subsisting ties with the UK (the continuous-residence requirement being a proxy for\u00a0demonstrating\u00a0such ties). The appellant argued that, by\u00a0failing to do\u00a0so, the Home Office had fettered its discretion.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Digital-only immigration system is causing stress,\u00a0fear\u00a0and exclusion\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">New\u00a0<a href=\"https:\/\/digitalgood.net\/dg-outputs\/exclusion-by-design\/\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">research<\/a>\u00a0by the University of Warwick with Migrant Voice has found that the Home Office digital-only immigration status is causing stress,\u00a0confusion\u00a0and exclusion for migrants across the UK.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The digitalisation of immigration status began in 2018 and is now mandatory for many. The findings show that people are struggling to navigate a system that is complex, glitch-prone&nbsp;and often lacks clear support.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords\u2019 limited awareness of share codes and inconsistent government communication, coupled with system failures during code verification, created stress and delays for migrants seeking housing who were subject to right-to-rent checks.&nbsp;One interviewee for the report explained that:&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>\u201c\u2026 although he was able to generate a share code for housing purposes, his landlord struggled to use it. Each time the landlord entered his share code on his side, the system&nbsp;failed to&nbsp;work. In this case, the issue was eventually resolved because the landlord continued to try and because it was the two of them meeting in person. The participant reflected that had they not been in person, the landlord might not have persisted, and he could have lost the opportunity to rent the property.\u201d<\/em>&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The report was also\u00a0<a href=\"https:\/\/www.theguardian.com\/uk-news\/2025\/dec\/05\/uks-new-digital-only-immigration-system-creating-exclusion-and-fear-study-finds\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">covered<\/a>\u00a0in\u00a0<em>the\u00a0Guardian.<\/em>\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Judicial review granted on the Home Office\u00a0eVisa\u00a0policy\u00a0\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Free Movement<\/em>\u00a0<a href=\"https:\/\/freemovement.org.uk\/permission-granted-for-judicial-review-of-the-home-offices-evisa-policy\/\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">reported<\/a>\u00a0that two organisations have raised a judicial review against the Home Office\u00a0eVisa\u00a0policy, via solicitors Deighton Pierce Glynn. The claim argues that providing proof of immigration status solely through digital\u00a0eVisas\u00a0and refusing to issue alternative proof when errors occur, or access is restricted, is illegal. Reported issues include incorrect personal or immigration details appearing in users\u2019 accounts, difficulties accessing or updating records, and individuals being locked out of their accounts altogether.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tackling poverty and destitution: No Recourse to Public Funds in Wales\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ahead of the Senedd election\u00a0in May, a\u00a0<a href=\"https:\/\/www.bevanfoundation.org\/resources\/tackling-poverty-and-destitution-no-recourse-to-public-funds-nrpf\/\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">Bevan Foundation briefing<\/a>\u00a0outlines measures that should be taken by the next Welsh\u00a0government to improve support to people with NRPF and to help prevent, as well as tackle,\u00a0poverty\u00a0and destitution.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The foundation calls on the next Welsh&nbsp;government to:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Extend eligibility for free school meals in secondary schools to children affected by NRPF\u00a0<\/li>\n\n\n\n<li>Develop clear practice guidance and quality standards The campaign\u00a0\u2014 \u2018Let\u2019s\u00a0Talk Facts\u00a0\u2014\u00a0Who Gets Our Homes?] \u2014\u00a0comes after a survey of more than 500 customers revealed that\u00a0nearly eight\u00a0in\u00a010\u00a0people\u00a0don\u2019t\u00a0fully understand how they decide who gets a home.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many respondents believed that factors such as immigration status or ethnicity influenced decisions and feel that local people&nbsp;don\u2019t&nbsp;have an equal opportunity to live in new homes that we build.&nbsp;The reality is&nbsp;very different.
